Changes in the Law on Child Restraints in Vehicles


  • comes into force on 18.9.2006

  • child restraints will need to be used for ALL children under 12 years old and under 135cm tall (children older and taller than this are able to wear adult seat belts) appropriate to their size, with some exceptions

  • This includes baby seats, booster seats and booster cushions



Exemptions Include:



  • licensed taxis or hire cars if there is no appropriate child restraint

  • a child age 3 and over, who because of unexpected necessity, is travelling over a short distance. this does not include school runs etc.

  • a child age 3 and over, in the back of a vehicle with 2 other children in child restraints, where there is not room for a third restrain

  • a disabled child who needs to use a seatbelt for disability, where none is available
